By entering a Down East photo contest you confirm acceptance of the guidelines.
- HOW TO ENTER: Enter photos using the online entry form. The photographs will be assessed by professional judges, who will select winners for each category. Additionally, there will be a winner chosen by popular vote, known as the Readers’ Choice Award.The Winners will receive prizes as listed on the contest landing page. Each submission is $10 per photo. Deadline is October 27, 2023. Generally, entry order is determined by successful, valid entry/submission as directed in the respective contest and is subject to Down East Enterprise Inc. [Herein after called “Down East”] review and approval. Down East reserves the right to determine valid entries. Entry deadline is noted in the respective contest.
- ELIGIBILITY: This contest is open to individuals who are 18 years of age or older at the time of submission and are residents of the United States, excluding jurisdictions where participation is restricted or prohibited by law. Those who are ineligible include employees of Down East, its affiliates, subsidiaries, the independent judging organization, as well as their immediate families and members of the same household. Entrants represent and warrant that their Submission is an original image, not copied from others, captured within the state of Maine, and it does not violate the rights of any other person or entity.
- RIGHTS: While the copyright of any Submission remains with the entrant, by participating in this Contest, the entrant grants Down East an irrevocable and perpetual right to publish the Submission without compensation and/or attribution. This permission allows Down East to use, reproduce, print, publish, transmit, communicate to the public, distribute, sell, perform, adapt, enhance, or display the Submission, alongside the entrant’s name, city, and state, for editorial, advertising, commercial and publicity purposes across all current and future media worldwide. This also includes the right to edit, adapt, and modify the Submission. To the extent allowed by law, these official rules exclude all implied conditions, warranties, and terms, whether arising from statute, general law, or customary practices.
- USE OF PERSONAL INFORMATION: The personal information you furnish (such as name, email address, physical address, phone number, etc.) may be stored in our customer database for potential use in contacting you about subscription offers, email newsletters, and sales-related communications in the future. Furthermore, you consent to allow Down East to share your data with our sponsoring partners for their online communications. Should you prefer not to receive such communications, you have the freedom to opt-out at any time. - WINNER SELECTION: Winners will be contacted via email, using the email address provided during entry. In cases where any communication regarding the prize, such as an email or notification, is returned as undeliverable—provided there is sufficient time to select and confirm an alternate winner—the prize will then be bestowed upon an alternate winner. Generally, winners will receive notification through email. To facilitate the award process, winners may be asked to supply their name, address, email address, phone number, and other necessary information. Down East’s decisions are final and binding concerning all aspects of this contest. Judges hold the authority to request original photo files, if they deem necessary, in lieu of submissions that have been significantly cropped or extensively digitally altered. The award is guaranteed for distribution, contingent on an adequate number of entries. Should a Submission receive a winning count of votes from both judges and online voting, the judges’ prize will be granted, and a readers’ choice runner-up will secure the readers’ choice prize.
- PRIZE: By accepting the prize, winners grant Down East permission for the use of their name and hometown in advertising, promotional, and publicity materials, without the need for additional compensation. In agreeing to the prize, the winner consents to release Down East Inc., its directors, employees, officers, and agents, judges, and sponsors—comprising, but not limited to, its advertising and promotion agencies—from any responsibility for liability, loss, or damages connected to the awarding, receipt, use, or misuse of the prize, or participation in any activities related to the prize. The winners are accountable for all tax obligations and income reporting.
- LIMITATION OF LIABILITY: Down East, the contest sponsors, and judges cannot be held liable for damaged, incomplete, entries or notices. Furthermore, Down East reserves the right, at its sole discretion, to modify, cancel, terminate, or suspend this Contest any time, for any reason or no reason at all, without recompense or recourse. You agree to release, indemnify and hold harmless Down East Enterprise Inc., its agents and employees, contest judges, and contest sponsors from any claim or proceeding resulting from your entry.
